The FAIR Plan - New Jersey
State
If your property is "high risk" and you cannot get home insurance through private companies, you may be able to get coverage from the New Jersey Fair Access to Insurance Requirements (FAIR) Plan.
About this program
If you live in New Jersey and have had trouble getting homeowners or property insurance, the New Jersey Fair Access to Insurance Requirements (FAIR) Plan may be able to help. This program gives people a way to get basic property insurance coverage when regular insurance companies won’t insure their home or business—often because it’s considered “high risk.”
The FAIR Plan is managed by the New Jersey Insurance Underwriting Association and helps ensure that homeowners have access to essential protection for their property.
What kind of insurance can I get from the New Jersey FAIR Plan?
The New Jersey FAIR Plan can insure homes, mobile homes, rental properties, commercial buildings, and business property. It provides basic property coverage and optional theft coverage, but it does not include personal liability coverage.
The FAIR Plan may cover damage caused by:
- Fire and lightning
- Explosions
- Wind and hail
- Smoke
- Aircraft or vehicle damage
- Riots or civil disturbances
- Vandalism or malicious mischief
- Mine subsidence (damage caused by underground mining activity)
The FAIR Plan does not cover:
- Flood damage
- Water damage from plumbing leaks or similar causes
- Building collapse
- Personal liability claims
Properties that do not qualify
Some properties cannot be insured through the FAIR Plan, including:
- Automobiles
- Farm property
- Properties with unpaid property taxes for six months or longer
- Vacant buildings
- Buildings that are unsafe, badly damaged, at risk of collapse, or have been condemned
- Buildings used to store flammable materials
- Properties that do not have basic services such as heat, water, or sewer service
- Properties with serious health or safety hazards that have not been fixed
- Properties being used for illegal activities, such as drug sales
- Properties that are not reasonably protected from fire or arson risks
Note: A property may also be denied coverage if the owner has been convicted of arson or insurance fraud involving a fire.
